Welcome to the AZÚCA App. These Terms of Use ("Terms") govern your access to and use of the AZÚCA App ("App"), including any services, features, and content made available through the App. By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree, you may not use the App.
 

1. Acceptance of Terms By creating an account or using the App, you represent that you are at least 18 years old or have the consent of a parent or guardian if you are a minor. You also agree to comply with all applicable laws and regulations.

2. App Use and Restrictions

You agree to use the App only for its intended purposes, which include:

  • Viewing and booking dance classes.

  • Accessing exclusive content, such as recap videos and schedules.

  • Purchasing merchandise or event tickets.
     

You agree not to:

  • Use the App for any unlawful or unauthorized purposes.

  • Access, tamper with, or use non-public areas of the App or AZÚCA’s systems.

  • Attempt to disrupt the functionality of the App through malicious software, unauthorized access, or any activity that imposes an unreasonable load on the App’s infrastructure.

  • Reproduce, distribute, modify, or create derivative works based on the App without express written permission from AZÚCA.

  • Misrepresent your identity, provide false information, or impersonate another person while using the App.

  • Upload, post, or transmit any content that is offensive, defamatory, or violates the rights of others.

  • Attempt to access or collect personal data of other users without their consent.

  • Use automated systems, such as bots, to interact with the App in any way without prior authorization from AZÚCA.
     

AZÚCA reserves the right to monitor usage of the App and take appropriate action, including termination of access, against users who violate these restrictions.

3. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. AZÚCA reserves the right to suspend or terminate accounts that violate these Terms or for other reasons at its sole discretion.

4. Payment and Refund Policy

All payments made through the App, including class bookings, merchandise purchases, and event tickets, are final and non-refundable unless otherwise stated. If a class or event is canceled by AZÚCA, you may be eligible for a refund or credit at AZÚCA’s discretion.

5. Intellectual Property

All content, designs, and features available through the App, including logos, videos, images, and text, are the intellectual property of AZÚCA Dance Company or its licensors. You may not use this content without prior written permission.

6. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you agree to the practices described in the Privacy Policy.

7. Modifications to the App and Terms

AZÚCA reserves the right to modify or discontinue the App or any features at any time without notice. We may also update these Terms periodically. Continued use of the App after updates constitutes acceptance of the revised Terms.

8. Disclaimers and Limitation of Liability

The App is provided "as is" and "as available." AZÚCA makes no warranties regarding the reliability, accuracy, or availability of the App. To the fullest extent permitted by law, AZÚCA shall not be liable for any damages arising out of your use or inability to use the App.

9. Termination

AZÚCA reserves the right to suspend or terminate your access to the App at any time for any reason, including violations of these Terms.
 

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any disputes arising out of these Terms or your use of the App will be resolved in the courts located in Hidalgo County, Texas.
